E Visa: Treaty Traders and Treaty Investors

The E visa is available for foreign nationals from a limited number of countries with special treaties with the United States. A list of countries that have a treaty of commerce and navigation with the U.S. is provided below:

What is the E Visa Duration and Extension Options?

The E visa is good for up to five years with a valid status for up to two years. The foreign national may apply for new E visas or E extensions as long as the person continues to engage in appropriate treaty activities. Dependent spouses or children are eligible for E status and may apply for employment authorization.


The E visa category contains two types of visas.


E-1 Treaty Traders Visa

The E-1 visa is specifically for foreign business owners, business managers, and employees who are required to stay in the U.S. for prolonged periods of time to oversee or work for an enterprise that is engaged in trade between the U.S. and the foreign country.


  • The foreign national must be a citizen/national of a treaty country;
  • The foreign national must engage in substantial trade between the U.S. and the treaty country (more than 50% of the trade is between the U.S. and the treaty country); and
  • The foreign national must show intent to depart the U.S. upon termination of status, ceasing business operations, or sale of business


E-2 Treaty Investors


The E-2 visa is available for a foreign national who is a citizen or national of a treaty country and wishes to enter the U.S. solely to develop and direct the operations of an enterprise in which this person has invested, or is in the process of investing a substantial amount of capital.


  • The foreign national must be a citizen/national of a treaty country;
  • The foreign national must have invested, or be investing, a substantial amount of capital in an enterprise in the U.S.; and
  • The foreign national must seek a U.S. visa solely to develop and direct the investment enterprise, proven by evidence showing that the foreign national owns at least 50% of the enterprise, or the person possesses operational control of the enterprise through a managerial or executive position.
