New Features of the USCIS FY2023 H-1B CAP Registration Process

The USCIS hosted an H-1B Electronic Registration Webinar on February 24, 2022. For H-1B Electronic Registration step-by-step guidance, please visit here. The following are some of the newly added features for the FY 2023 H-1B Electronic Registration System:

Duplicate Submission Checker:
Duplicate submission is prohibited in the H-1B Electronic Registration Process, which makes the registration invalid. This new feature allows representatives or employers to verify whether the registrant (employer or representatives) in the draft submission previously submitted a registration for any of the beneficiaries included in the draft submission for the same fiscal year. This feature is an affirmative process (i.e., you must perform the check as it will not occur automatically).
Please note that the process does not provide a guarantee that a duplicate was not submitted as it only checks for duplicates in cases that have been submitted and not draft cases that could still be submitted. In other words, it will not check for duplicates within that draft or within other drafts .

Account Type Correction:
If an employer creates an account in the wrong type (i.e., as an applicant or petitioner), the system now allows for the account to be deleted if certification and account information have not been submitted. You may delete this account here . However, o nce you certify and submit your account information, you will not be able to delete your account.
To delete an account, under the account profile there is an option to “Edit.” At the bottom of the page, there is an option to delete the account. There cannot be any data in the account. The notation on the myUSCIS account on the bottom of the page will state:
Note: You may delete this account ( https://myaccount.uscis.gov/users/edit ) if you created the wrong account type, or if you no longer want it. Once you certify and submit your account information, you will be unable to delete your account. -
Attestation Requirement:
For FY 2023, the attestation that is required before submission will indicate, “I further certify that this registration (or these registrations) reflects a legitimate job offer and that I, or the organization on whose behalf this registration (or these registrations) is being submitted, have not worked with, or agreed to work with, another registrant, petitioner, agent, or other individual or entity to submit a registration to unfairly increase chances of selection for the beneficiary or beneficiaries in this submission.”
This attestation means that the USCIS wants employers and representatives to confirm and attest under the penalty of perjury that there is a H-1B eligible position open for the particular beneficiary, and that once the registration is selected, the H-1B petition must be submitted.The USCIS may refer the individual or entity who submitted a false attestation to appropriate federal law enforcement agencies for investigation and further action as appropriate.
It is therefore important for an employer to consult an attorney, before you submit any H-1B Electronic Registration, to ensure that the offered position is qualified for a specialized occupation under the H-1B regulations, that the employer’s offered salary meets the requirements, and that the foreign national is qualified for such position according to the regulations.
