Applying For A Green Card Through Non-LPR Cancellation of Removal
Non-LPR Cancellation of Removal is a path to a Green Card for a foreign-born person who has been living in the U.S. without legal status for a long time. To be eligible for this form of relief, the following must exist:
- Continuous physical present in the U.S. for at least ten years;
- Applicant must be in removal proceedings;
- A removal from the U.S. would cause exceptional and extremely unusual hardship to your qualifying relative who is a U.S. citizen or lawful permanent resident (LPR);
- Proof of good moral character; and
- No conviction of certain crimes or violated certain laws.
However, eligibility to submit an application for cancellation of removal means that the application could still be denied. The immigration judge has the discretion to approve or deny the cancellation. It is a wise move to seek the assistance of an immigration attorney to help prove the eligibility requirements, but also that the applicant deserves the benefits of cancellation.
From a national perspective, cancellation of removal has an approval cap of 4,000 per year. The cap means that some periods of the year, this process would be unavailable. Meaning, someone may be eligible and an ideal candidate, but the immigration judge would not have any spots available for the applicant.
U.S. Residence Requirement
Generally, someone must be continuous and physically present in the U.S. for ten years before they apply for cancellation. However, there is an exception if two years of active-duty service in the U.S. armed forces had occurred.
LPR Cancellation DIFFERS FROM non-LPR Cancellation
LPR Cancellation of Removal is very different from Non-LPR Cancellation of Removal. LPR Cancellation only requires (1) 5 years as a Lawful Permanent Resident; (2) 7 years of continuous residence in the U.S.; and (3) no aggravated felony convictions. LPR Cancellation does not require a showing of hardship and there is also no annual cap of applicants who can receive LPR cancellation.
